\u00a7 1 Geltungs- und Anwendungsbereich<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) Diese AGB gelten\u00a0 f\u00fcr alle eigenen und vermittelten Leistungen der Art & Juxtaposition Projects gGmbH. Hierzu z\u00e4hlen zum Beispiel der individuelle Besuch der Sammlung, tempor\u00e4ren Ausstellungen, F\u00fchrungen, Ceremonies, Vortr\u00e4ge und Workshops.<\/p>\n

(2) Durch Vertragsschluss akzeptiert der Vertragspartner diese AGB. Im Fall der Inanspruchnahme einer Leistung f\u00fcr Dritte obliegt es dem Mitglied, darauf hinzuweisen, dass gegen\u00fcber jedem Besucher diese AGB gelten.[\/vc_column_text]

\u00a7 2 Hausordnung und Benutzung<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text]Das Mitglied ist verpflichtet, die Verhaltensregeln, auf die im Eingangsbereich der Feuerle Collection im Rahmen der Hausordnung hingewiesen wird, einzuhalten. Eine Nichtbeachtung der Hausordnung kann zum entsch\u00e4digungslosen Verlust der Zutrittsberechtigung f\u00fchren.[\/vc_column_text]
<\/div>[vc_column_text]\n

\u00a7 3 Haftung<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) Der Aufenthalt im Geb\u00e4ude oder sonstigen Teilen des Anwesens der Art & Juxtaposition Projects gGmbH am Halleschen Ufer 70 in 10963 Berlin erfolgt auf eigene Gefahr.<\/p>\n

(2) Soweit der Art & Juxtaposition Projects gGmbH, ihre gesetzlichen Vertreter oder Erf\u00fcllungsgehilfen keine vors\u00e4tzliche Vertragsverletzung zur Last f\u00e4llt, ist die Schadensersatzhaftung auf den vorhersehbaren und typischerweise eintretenden Schaden begrenzt. Im \u00dcbrigen ist die Haftung ausgeschlossen; Anspr\u00fcche f\u00fcr Sch\u00e4den aus der Verletzung des Lebens, des K\u00f6rpers oder der Gesundheit, bleiben hiervon unber\u00fchrt.<\/p>\n

(3) Das Mitglied haftet f\u00fcr alle durch ihn und\/oder seine G\u00e4ste schuldhaft verursachten Verunreinigungen, Besch\u00e4digungen an Geb\u00e4ude oder Inventar sowie sonstige Sch\u00e4den.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 4 Datenschutz<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) Zur Abwicklung des Vertragsverh\u00e4ltnisses werden f\u00fcr die Dauer der Vertragsbeziehung Name und Anschrift sowie E-Mail-Adresse und Telefonnummer des Mitglieds gem\u00e4\u00df den Bestimmungen der EU-Datenschutzgrundverordnung vom 25. Mai 2018 gespeichert und genutzt. Auf diese Daten haben die mit der Abwicklung des Vertragsverh\u00e4ltnisses befassten Besch\u00e4ftigten der Art & Juxtaposition Projects gGmbH, der Oso Investments S.L. und die des daf\u00fcr beauftragten und auf den sorgf\u00e4ltigen Umgang mit diesen Daten eigens verpflichteten Dienstleistungsunternehmens ausschlie\u00dflich f\u00fcr Zwecke der Vertragsabwicklung Zugriff. \u00dcber \u00c4nderungen dieser Daten unterrichten die Mitglieder die Art & Juxtaposition Projects gGmbH umgehend.<\/p>\n

(2) Mit dem ausdr\u00fccklichen Einverst\u00e4ndnis des Mitglieds k\u00f6nnen Name, Anschrift, Telefonnummer sowie E-Mail-Adresse auch in eine allgemeine Adressen-Datei der Art & Juxtaposition Projects gGmbH \u00fcbernommen werden, die der Mitgliederbetreuung und -information dient.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 5 Schlussbestimmungen<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) Die Art & Juxtaposition Projects gGmbH beh\u00e4lt sich vor, diese Bedingungen jeder Zeit und ohne Angabe von Gr\u00fcnden zu \u00e4ndern. Dies gilt nicht f\u00fcr bereits abgeschlossene Mitgliedschaftsvertr\u00e4ge. Sollten einzelne der obenstehenden Regelungen unwirksam oder nichtig sein, so wird im \u00dcbrigen hierdurch die G\u00fcltigkeit des Vertrages nicht ber\u00fchrt.<\/p>\n

(2) Es gilt ausschlie\u00dflich das Recht der Bundesrepublik Deutschland. Alleiniger Erf\u00fcllungsort f\u00fcr Zahlung, Lieferung und Leistung ist Berlin. Der Gerichtsstand f\u00fcr Streitigkeiten mit Kaufleuten, juristischen Personen des \u00f6ffentlichen Rechts und \u00f6ffentlich-rechtlichen Sonderverm\u00f6gen sowie Personen, die ihren Wohnsitz oder gew\u00f6hnlichen Aufenthaltsort im Ausland haben, ist Berlin.<\/p>\n

(3) Rechtliche Verbindlichkeit entfaltet alleine die deutsche Fassung dieser AGB. Die englischsprachige Version dient alleine der besseren Verst\u00e4ndlichkeit.<\/p>\n[\/vc_column_text]

\u00a7 1 Validity and scope of application<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) These GTC apply to all own and provided services of Art & Juxtaposition Projects gGmbH. These include, for example, individual visits to the collection, temporary exhibitions, guided tours, ceremonies, lectures and workshops.<\/p>\n

(2) By concluding the contract, the contracting party accepts these GTC. In the event of the use of a service for third parties, it is the member\u2019s responsibility to inform that these GTC apply to every visitor.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 2 House rules and use of the facilities<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text]The member is obliged to observe the rules of conduct which are referred to in the entrance area of the Feuerle Collection within the framework of the house rules. Non-compliance with the house rules may result in the loss of access authorisation without compensation.[\/vc_column_text]
<\/div>[vc_column_text]\n

\u00a7 3 Liability<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) The stay in the building or other parts of the property of Art & Juxtaposition Projects gGmbH at Halleschen Ufer 70 in 10963 Berlin shall be at one\u2019s own risk.<\/p>\n

(2) Insofar as Art & Juxtaposition Projects gGmbH, its legal representatives or vicarious agents are not guilty of intentional breach of contract, liability for damages shall be limited to the foreseeable and typically occurring damage. Otherwise, liability is excluded; claims for damages arising from injury to life, limb or health shall remain unaffected.<\/p>\n

(3) The member is liable for all contaminations, damages to buildings or inventory as well as other damages culpably caused by the member and\/or his\/her guests.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 4 Data protection<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) For the purpose of processing the contractual relationship, the name, address, e-mail address and telephone number of the member shall be stored and used for the duration of the contractual relationship in accordance with the provisions of the EU Basic Data Protection Regulation of 25 May 2018. The employees of Art & Juxtaposition Projects gGmbH, Oso Investments S.L. and the service company commissioned for this purpose and specifically obliged to handle this data carefully have access to this data exclusively for the purposes of contract execution. The members shall inform Art & Juxtaposition Projects gGmbH immediately of any changes to this data.<\/p>\n

(2) With the express consent of the member, the name, address, telephone number and e-mail address may also be included in a general address file of Art & Juxtaposition Projects gGmbH for the purpose of member support and information.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 5 Final provisions<\/h1>\n[\/vc_column_text]
<\/div>[vc_column_text](1) Art & Juxtaposition Projects gGmbH reserves the right to change these conditions at any time and without giving reasons. This does not apply to already concluded membership contracts. Should any of the above provisions be invalid or void, this shall not affect the validity of the remainder of the contract.<\/p>\n

(2) The law of the Federal Republic of Germany applies exclusively. The sole place of performance for payment, delivery and performance shall be Berlin. The place of jurisdiction for disputes with merchants, legal entities under public law and special funds under public law as well as persons who have their domicile or habitual residence abroad is Berlin.<\/p>\n

(3) Only the German version of these GTC shall be legally binding. The English version serves only for better comprehensibility.[\/vc_column_text]
