\u00a0 \u00a7 1 Vertragsgegenstand<\/h2>\n<\/td>\n

Article 1 – Object of agreement<\/td>\n<\/tr>\n
(1) Gegenstand des Vertrages ist die Gew\u00e4hrung von Mitgliedschaftsvorteilen durch The Feuerle Collection in nachstehend bestimmtem Umfang.<\/p>\n

(2) Die Art & Juxtaposition Projects gGmbH tritt bei der Gew\u00e4hrung der Mitgliedschaftsvorteile als Vermittlerin auf. Die Mitgliedschaftsvorteile werden von Dritten zur Verf\u00fcgung gestellt.<\/td>\n

(1) Subject to the terms and conditions of this Agreement is that The Feuerle Collection shall provide the member with the benefits agreed upon.<\/p>\n

(2) By providing the benefits Art & Juxtaposition Projects gGmbH acts as an intermediary. The membership benefits are provided by a third party.<\/td>\n<\/tr>\n

\u00a7 2 Mitgliedschaftsvorteile<\/strong><\/p>\n

Folgende Mitgliedschaftsvorteile werden jeweils einmal j\u00e4hrlich gew\u00e4hrt:<\/p>\n

Drei Besuche f\u00fcr zwei Personen (Mitglied und ein Gast) w\u00e4hrend der regul\u00e4ren \u00d6ffnungszeiten.<\/p>\n

Einladung zu nicht \u00f6ffentlichen Previews der tempor\u00e4ren Ausstellungen.<\/p>\n

Vorrangige Informationen zu relevanten Veranstaltungen und Besuchen.<\/p>\n

10 % Preisnachlass auf die Teilnahme an der Incense Ceremony.<\/p>\n

\u00a7 3 Vertragsdauer und K\u00fcndigungsrecht<\/strong><\/p>\n

(1) Der Vertrag endet ein Jahr nach Vertragsschluss.<\/p>\n

(2) Der Vertrag ist beiderseitig, mit einer Frist von vier Wochen zum Ende der jeweiligen Vertragslaufzeit schriftlich k\u00fcndbar.<\/p>\n

(3) Wird der Vertrag nicht fristgerecht gek\u00fcndigt, verl\u00e4ngert sich dieser automatisch je um ein weiteres Jahr.<\/p>\n

\u00a7 4 Mitgliedschaftsbeitr\u00e4ge<\/strong><\/p>\n

(1) Der j\u00e4hrliche Mitgliedschaftsbeitrag betr\u00e4gt j\u00e4hrlich 500,00 \u20ac und ist mit Vertragsschluss sofort f\u00e4llig.<\/p>\n

(2) Die Zahlung der Mitgliedsbeitr\u00e4ge erfolgt an:<\/p>\n

\u00a7 5 Allgemeine Gesch\u00e4ftsbedingungen<\/strong><\/p>\n

Das Mitglied versichert, die diesem Vertrag beiliegenden Allgemeinen Gesch\u00e4ftsbedingungen zur Kenntnis genommen zu haben.<\/p>\n

\u00a7 6 Schlussbestimmungen<\/strong><\/td>\n

Article 2 – Benefits of membership<\/strong><\/p>\n

The following benefits shall be provided each once a year<\/p>\n

(1)\u00a0\u00a0 Three visits for two persons (member and one guest) during the regular opening hours.<\/p>\n

(2)\u00a0\u00a0 Invitation to private previews of temporary exhibitions.<\/p>\n

(3)\u00a0\u00a0 Priority information about relevant events and visits.<\/p>\n

(4)\u00a0\u00a0 10 % price reduction on the Incense Ceremony.<\/p>\n

 <\/p>\n

Article 3 – Duration and termination<\/strong><\/p>\n

(1) This Agreement shall terminate one year after the date of closing.<\/p>\n

(2) The contract can be terminated in writing by either party with a period of notice of four weeks to the end of the respective contract period.<\/p>\n

(3) If the contract is not terminated in due time, it will automatically be extended by a further year.<\/p>\n

Article 4 – Membership fees<\/strong><\/p>\n

(1) The annual membership fee is 500,00\u00a0\u20ac annually and is due immediately upon conclusion of the contract.<\/p>\n

\u00a7 5 General Terms and Conditions<\/strong><\/p>\n

The member confirms having read and understood the General Terms and Conditions attached to this contract.<\/p>\n

Article 6 – Final provisions <\/strong><\/p>\n

(1) Subsidiary oral agreements to this contract do not exist. Any amendment or addition to the contract must be made in writing.<\/p>\n

(2) Should individual provisions of this contract be or become invalid, this shall not affect the validity of the remaining provisions. The contractual partners are obliged to replace ineffective provisions with provisions that come as close as possible to the intended economic and content purpose of this contract.<\/p>\n

(3) The place of jurisdiction for disputes arising from this contract is Berlin.<\/p>\n

(4) This contractual relationship and any claims arising from this contractual relationship shall be governed exclusively by German law to the exclusion of the law of conflict.<\/p>\n

(5) Only the German language versions are legally binding, while the English language versions are for better comprehensibility only.<\/p>\n

(6) Should individual or several provisions of this contract be or become wholly or partially void or ineffective, the validity of the remaining provisions shall not be affected. Instead of the ineffective provision, the effective provision shall be deemed to have been agreed which corresponds as closely as possible to the sense and purpose of the economic intention of the parties.<\/p>\n

 <\/td>\n<\/tr>\n

(1) M\u00fcndliche Nebenabsprachen zu diesem Vertrag bestehen nicht. Jede \u00c4nderung oder Erg\u00e4nzung des Vertrages bedarf der Schriftform.<\/p>\n

(2) Sollten einzelne Bestimmungen dieses Vertrages unwirksam sein oder werden, dann wird dadurch die Wirksamkeit der \u00fcbrigen Bestimmungen nicht ber\u00fchrt. Die Vertragspartner sind verpflichtet, unwirksame Bestimmungen durch solche zu ersetzen, die dem angestrebten wirtschaftlichen und inhaltlichen Zweck dieses Vertrages am n\u00e4chsten kommen.<\/p>\n

(3) Gerichtsstand f\u00fcr Streitigkeiten aus diesem Vertrag ist Berlin.<\/p>\n

(4) Auf dieses Vertragsverh\u00e4ltnis sowie auf Anspr\u00fcche, die aus diesem Vertragsverh\u00e4ltnis erwachsen, ist ausschlie\u00dflich deutsches Recht unter Ausschluss des Kollisionsrechts anzuwenden.<\/p>\n

(5) Rechtlich verbindlich sind lediglich die deutschsprachigen Ausf\u00fchrungen, w\u00e4hrend die englischsprachigen nur der besseren Verst\u00e4ndlichkeit dienen.<\/p>\n

(6) Sollten einzelne oder mehrere Bestimmungen dieses Vertrages ganz oder teilweise nichtig oder unwirksam sein oder werden, so wird die G\u00fcltigkeit der \u00fcbrigen Bestimmungen nicht ber\u00fchrt. Anstelle der unwirksamen Bestimmung gilt diejenige wirksame Bestimmung als vereinbart, die Sinn und Zweck des wirtschaftlich Gewollten der Parteien am ehesten entspricht.<\/td>\n<\/tr>\n
