\u00a7 1\u00a0\u00a0Vertragsgegenstand<\/h1>\n[\/vc_column_text][vc_column_text](1) Gegenstand\u00a0des Vertrages ist die Gew\u00e4hrung von Mitgliedschaftsvorteilen durch The\u00a0Feuerle Collection in nachstehend bestimmtem Umfang.<\/p>\n

(2) Die\u00a0Art & Juxtaposition Projects gGmbH\u00a0tritt bei der Gew\u00e4hrung der Mitgliedschaftsvorteile\u00a0als Vermittlerin auf. Die\u00a0Mitgliedschaftsvorteile werden von Dritten zur Verf\u00fcgung gestellt.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 2 Mitgliedschaftsvorteile<\/h1>\n[\/vc_column_text][vc_column_text]Folgende\u00a0Mitgliedschaftsvorteile werden jeweils einmal j\u00e4hrlich gew\u00e4hrt:<\/p>\n

(1) Drei\u00a0Besuche f\u00fcr zwei Personen (Mitglied und ein Gast) w\u00e4hrend der regul\u00e4ren\u00a0\u00d6ffnungszeiten.<\/p>\n

(2) Einladung\u00a0zu nicht \u00f6ffentlichen Previews der tempor\u00e4ren Ausstellungen.<\/p>\n

(3) Vorrangige\u00a0Informationen zu relevanten Veranstaltungen und Besuchen.<\/p>\n

(4) 10 %\u00a0Preisnachlass auf die Teilnahme an der Incense Ceremony.[\/vc_column_text]

<\/div>[vc_column_text]\n

\u00a7 3 Vertragsdauer\u00a0und K\u00fcndigungsrecht<\/h1>\n[\/vc_column_text][vc_column_text](1) Der\u00a0Vertrag endet ein Jahr nach Vertragsschluss.<\/p>\n

(2) Der\u00a0Vertrag ist beiderseitig, mit einer Frist von vier Wochen zum Ende der\u00a0jeweiligen\u00a0Vertragslaufzeit schriftlich k\u00fcndbar.<\/p>\n

(3) Wird der Vertrag nicht fristgerecht\u00a0gek\u00fcndigt, verl\u00e4ngert sich dieser automatisch je um ein\u00a0weiteres Jahr.[\/vc_column_text]

\u00a7 4 Mitgliedschaftsbeitr\u00e4ge<\/h1>\n[\/vc_column_text][vc_column_text](1) Der\u00a0j\u00e4hrliche Mitgliedschaftsbeitrag betr\u00e4gt j\u00e4hrlich 500,00 \u20ac und ist mit\u00a0Vertragsschluss\u00a0sofort f\u00e4llig.<\/p>\n

(2) Die\u00a0Zahlung der Mitgliedsbeitr\u00e4ge erfolgt an:<\/p>\n

\u00a7 5\u00a0Allgemeine Gesch\u00e4ftsbedingungen<\/h1>\n[\/vc_column_text][vc_column_text]Das\u00a0Mitglied versichert, die diesem Vertrag beiliegenden Allgemeinen\u00a0Gesch\u00e4ftsbedingungen\u00a0zur Kenntnis genommen zu haben.[\/vc_column_text]
<\/div>[vc_column_text]\n

\u00a7 6 Schlussbestimmungen<\/h1>\n[\/vc_column_text][vc_column_text](1) M\u00fcndliche\u00a0Nebenabsprachen zu diesem Vertrag bestehen nicht. Jede \u00c4nderung oder\u00a0Erg\u00e4nzung des Vertrages bedarf der Schriftform.<\/p>\n

(2) Sollten einzelne Bestimmungen dieses\u00a0Vertrages unwirksam sein oder werden, dann wird\u00a0dadurch die Wirksamkeit der\u00a0\u00fcbrigen Bestimmungen nicht ber\u00fchrt. Die Vertragspartner sind\u00a0verpflichtet,\u00a0unwirksame Bestimmungen durch solche zu ersetzen, die dem angestrebten\u00a0wirtschaftlichen und inhaltlichen Zweck dieses Vertrages am n\u00e4chsten kommen.<\/p>\n

(3) Gerichtsstand\u00a0f\u00fcr Streitigkeiten aus diesem Vertrag ist Berlin.<\/p>\n

(4) Auf\u00a0dieses Vertragsverh\u00e4ltnis sowie auf Anspr\u00fcche, die aus diesem\u00a0Vertragsverh\u00e4ltnis\u00a0erwachsen, ist ausschlie\u00dflich deutsches Recht unter\u00a0Ausschluss des Kollisionsrechts\u00a0anzuwenden.<\/p>\n

(5) Rechtlich\u00a0verbindlich sind lediglich die deutschsprachigen Ausf\u00fchrungen, w\u00e4hrend die\u00a0englischsprachigen nur der besseren Verst\u00e4ndlichkeit dienen.<\/p>\n

(6) Sollten\u00a0einzelne oder mehrere Bestimmungen dieses Vertrages ganz oder teilweise\u00a0nichtig\u00a0oder unwirksam sein oder werden, so wird die G\u00fcltigkeit der \u00fcbrigen\u00a0Bestimmungen nicht\u00a0ber\u00fchrt. Article\u00a01 – Object of agreement<\/h1>\n[\/vc_column_text][vc_column_text](1) Subject to the terms and\u00a0conditions\u00a0of this Agreement is that The Feuerle\u00a0Collection shall provide the\u00a0member\u00a0with the benefits agreed upon.<\/p>\n

(2) By providing the benefits Art\u00a0&\u00a0Juxtaposition Projects gGmbH acts as\u00a0an intermediary. The membership\u00a0benefits are provided by a third party.[\/vc_column_text]

<\/div>[vc_column_text]\n

Article 2 – Benefits of membership<\/h1>\n[\/vc_column_text][vc_column_text]The\u00a0following benefits shall be provided\u00a0each once a year<\/p>\n

(1)\u00a0 \u00a0Three\u00a0visits for two persons\u00a0(member and one guest) during the\u00a0regular opening\u00a0hours.<\/p>\n

(2)\u00a0 \u00a0Invitation\u00a0to private previews of\u00a0temporary exhibitions.<\/p>\n

(3)\u00a0 \u00a0Priority\u00a0information about relevant\u00a0events and visits.<\/p>\n

(4)\u00a0 \u00a010 %\u00a0price reduction on the Incense\u00a0Ceremony.[\/vc_column_text]

<\/div>[vc_column_text]\n

Article 3 – Duration and termination<\/h1>\n[\/vc_column_text][vc_column_text](1) This Agreement shall terminate one\u00a0year\u00a0after the date of closing.<\/p>\n

(2) The contract can be terminated in\u00a0writing by\u00a0either party with a period of\u00a0notice of four weeks to the end of the\u00a0respective contract period.<\/p>\n

(3) If the\u00a0contract is not terminated in\u00a0due time, it will automatically be\u00a0extended by\u00a0a further year.[\/vc_column_text]

Article 4 – Membership fees<\/h1>\n[\/vc_column_text][vc_column_text](1) The annual\u00a0membership fee is\u00a0500,00 \u20ac annually and is due\u00a0immediately upon\u00a0conclusion of the\u00a0contract.<\/p>\n

(2) Membership fees are to be paid to\u00a0the\u00a0following account:<\/p>\n

\u00a7 5 General Terms\u00a0and Conditions<\/h1>\n[\/vc_column_text][vc_column_text]The member\u00a0confirms having read and\u00a0understood the General Terms and\u00a0Conditions attached\u00a0to this contract.[\/vc_column_text]
<\/div>[vc_column_text]\n

Article 6 – Final provisions<\/h1>\n[\/vc_column_text][vc_column_text](1) Subsidiary oral agreements to this\u00a0contract\u00a0do not exist. Any amendment\u00a0or addition to the contract must be\u00a0made in\u00a0writing.<\/p>\n

(2) Should individual provisions of this\u00a0contract be or become invalid, this shall\u00a0not affect the validity of the\u00a0remaining\u00a0provisions. The contractual partners are\u00a0obliged to replace\u00a0ineffective provisions\u00a0with provisions that come as close as\u00a0possible to the\u00a0intended economic and\u00a0content purpose of this contract.<\/p>\n

(3) The place of jurisdiction for disputes\u00a0arising from this contract is Berlin.<\/p>\n

(4) This contractual relationship and any\u00a0claims\u00a0arising from this contractual\u00a0relationship shall be governed\u00a0exclusively by\u00a0German law to the\u00a0exclusion of the law of conflict.<\/p>\n

(5) Only the German language versions\u00a0are\u00a0legally binding, while the English\u00a0language versions are for better\u00a0comprehensibility\u00a0only.<\/p>\n

(6) Should individual or several\u00a0provisions of\u00a0this contract be or become\u00a0wholly or partially void or ineffective, the\u00a0\u00a0\u00a0validity of the remaining provisions shall\u00a0not be affected. Instead of the\u00a0ineffective provision, the effective\u00a0provision shall be deemed to have been\u00a0\u00a0\u00a0agreed which corresponds as closely as\u00a0possible to the sense and purpose of\u00a0the economic intention of the parties.[\/vc_column_text]
